1. Complaints and Grievances Policy

We are committed to a supportive environment for holistic practice and learning. If you are dissatisfied with our services—including the conduct of trainers, subcontractors, or fellow participants—we aim to resolve concerns fairly and promptly.

Complaint resolution process

Formal complaints are addressed within 20 working days where reasonably practicable (often sooner), following principles of natural justice and procedural fairness.

How to file a complaint

Start by discussing concerns informally with your trainer or a trusted staff member. If unresolved, file a formal complaint by:

1. Emailing info@shakingmedicine.com with “Complaint” in the subject line.
2. Providing your name, contact details, and a clear description of the issue, including steps already taken.

Complaints must be submitted by the affected individual and will be investigated thoroughly. You may bring a representative to related meetings. The process may include:

• Reviewing documentation and interviewing involved parties
• Communicating outcomes by email
• Escalating unresolved cases to the Shaking Medicine chief executive
• Offering an independent third-party review if needed, with mutual agreement on the third party’s impartiality

Records of complaints are stored securely. Calls or interviews may be recorded for resolution purposes where permitted by law and with appropriate notice. Senior management may review finalized complaints to improve services. You may withdraw a complaint at any time, closing the matter.

2. Privacy Policy

The Shaking Medicine Foundation prioritizes your privacy when you engage with our website and services, from online courses to workshops. This Privacy Policy is intended to align with applicable U.S. frameworks (including CCPA/CPRA and COPPA) and international standards (including GDPR and LGPD where they apply), and explains how we collect, use, and protect personal information.

Data we collect

We do not require you to provide personal information merely to browse the public pages of our website. Limited technical data (for example browser type, approximate location derived from IP address, or device information) may be processed automatically to operate and improve the site.

Personal information is collected when you provide it voluntarily, such as through:

• Course registrations, workshop bookings, community sign-ups, or mailing lists
• Inquiries, surveys, or offers requesting your name, email, or preferences
• Purchases or bookings processed via third-party payment or platform providers

How we use data

We use personal information to:

• Provide and improve our services (including courses, coaching, training, and events)
• Communicate with you about your registration, support requests, or—with your consent—updates and events

Children’s privacy

We do not knowingly collect personal data from children under 16 (or under the age required by local law, including COPPA protections for children under 13 in the United States). If we learn that we have collected such data, we will delete it. Parents and guardians should supervise minors’ online activity.

Your rights

Depending on where you live, you may have rights to:

• Access, correct, or delete personal information we hold about you
• Object to or restrict certain processing, or withdraw consent where processing is based on consent
• Opt out of marketing communications
• For California residents: exercise CCPA/CPRA rights, including requests related to the sale or sharing of personal information (we do not sell personal information)
• For individuals in the EU/EEA/UK: lodge a complaint with a local data protection authority

To exercise privacy rights, email info@shakingmedicine.com with a clear subject such as “Privacy Request”, “Personal Information Review Request”, or “Delete Account”. We may need to verify your identity before fulfilling a request. We will respond within the timeframes required by applicable law.

Security and international transfers

We use technical, administrative, and organizational measures appropriate to the risk to protect personal information. Our site and related infrastructure may be hosted by third parties (including Hostinger) and may process data in multiple jurisdictions, including the United States. Where required, cross-border transfers are supported by appropriate safeguards. No method of transmission or storage is 100% secure; you use our site and services at your own risk regarding residual security risks.

Third-party platforms we use (for example Skool for community courses, payment processors, or social networks) process data under their own privacy policies when you interact with those services.

3. Terms of Use

By accessing www.shakingmedicine.com or our services, you agree to these Terms of Use. If you disagree, do not use our website or services. You represent that you have legal capacity to enter into these terms (and, if you use services on behalf of an organization, that you are authorized to bind that organization).

Content license

Our website, videos, training materials, and other content (“Content”) are owned by the Shaking Medicine Foundation or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license for personal, non-commercial use only, unless a separate written agreement says otherwise. Copying, reproducing, redistributing, scraping, or creating derivative works from Content without prior written permission is prohibited and may violate copyright or trademark laws.

Intellectual property

All Content is protected by copyright and other IP laws. Trademarks are owned by us or used with permission. Report suspected IP violations to info@shakingmedicine.com with supporting details.

Health disclaimer (summary)

Shaking Medicine is educational and wellness-oriented. It is not medical advice and is not a substitute for professional healthcare. See the Health and Safety Disclaimer below.

User obligations

• You agree to provide accurate information when registering or booking.
• You consent to receive service-related electronic notices at the contact details you provide.
• Event recordings may be shared publicly when that is disclosed in advance for the relevant event.
• Comments, feedback, or suggestions you submit may be used by the Foundation without obligation to compensate you.
• You will not misuse the site (including attempting to disrupt security, harass others, or upload unlawful content).

Third-party services

Services may depend on third parties (for example Hostinger hosting, Skool community platform, Stripe or other payment processors, or social media). Their terms and privacy policies govern your relationship with them. We are not responsible for outages or policies of third parties beyond our reasonable control.

Limitation of liability

To the maximum extent permitted by applicable law, the Shaking Medicine Foundation and its directors, trainers, and affiliates are not liable for indirect, incidental, consequential, special, or punitive damages, or for loss of data, profits, or goodwill, arising from your use of the site or services. Where liability cannot be excluded, it is limited to the amount you paid us for the specific service giving rise to the claim in the twelve (12) months before the claim (or, if none, to the minimum amount permitted by law).

Assumption of risk

Somatic and movement practices involve physical and emotional processes. You assume the risks of voluntary participation in online or in-person sessions, workshops, and trainings, subject to non-waivable consumer or other rights under your local law.

Certified teachers

Independent certified Shaking Medicine teachers are responsible for their own insurance, local compliance, and client relationships. They should credit the Foundation appropriately when representing the modality.

Termination

We may suspend or terminate access to the site or services for violations of these terms, unlawful activity, or to protect users or the Foundation, to the extent permitted by law.

Governing law and disputes

These terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules, except where mandatory local consumer laws apply. Subject to those mandatory rights, courts in Orange County, California, shall have exclusive jurisdiction over disputes arising from these terms or your use of the site.

General

If any provision is held unenforceable, the remaining provisions remain in effect. These Terms and Policies, together with any service-specific terms presented at purchase or enrollment, constitute the entire agreement regarding the subject matter here. We may update these terms by posting a revised version on this page; material changes will be reflected by an updated date. Continued use after changes constitutes acceptance of the revised terms where permitted by law.

4. Refund Policy

As a not-for-profit spreading Shaking Medicine globally, we manage funds carefully to support our mission. Refund rules vary by service type.

General

Refunds are offered for errors on our part (for example accidental duplicate purchases), typically less applicable processing fees. Store credit or transferred balances, if issued, expire after one year unless a longer period is required by law.

Online courses

Pre-recorded courses are generally non-refundable because digital access is provided immediately upon purchase.

Private sessions and teacher training

Live sessions may be rescheduled if the facilitator (or their technology under their control) is at fault. Teacher trainings, 1:1 or group programs, and coaching packages are non-refundable unless required otherwise by mandatory consumer law.

Subscription services

You are responsible for canceling recurring payments before the next billing date. We do not refund periods already paid because of a forgotten cancellation. Access continues until the paid period ends. Maintaining membership helps support the Foundation’s mission.

Live events

Workshops, retreats, and immersions are generally non-refundable. If we cancel an event, you may transfer payment to another offering or receive a full refund of amounts paid to us. We are not liable for your travel, accommodation, or other third-party expenses.

Technical issues

For live-streamed events disrupted by technical issues, we will reasonably attempt to reschedule or provide a recording. Refunds are not generally offered for participant-side connectivity problems.

6. Health and Safety Disclaimer

Shaking Medicine draws on therapeutic tremoring, somatic practice, and indigenous and contemporary wisdom traditions. It supports holistic wellness and nervous-system education but is not a substitute for medical, psychological, or psychiatric advice, diagnosis, or treatment.

Cautions for practice

We emphasize mindful engagement. Consult a qualified healthcare professional before starting, especially if you:

• Are pregnant or postpartum
• Have medical or psychiatric conditions (for example heart issues, epilepsy, or complex trauma)
• Are recovering from injury or surgery
• Take medications or have a history of dissociation or psychosis

We do not claim to diagnose, treat, cure, or prevent any disease. Words such as “heal” are used in a general wellness sense, not as medical claims. Results vary. No outcomes are guaranteed.

Participation—online or in person—is voluntary and at your own risk. To the fullest extent permitted by law, the Shaking Medicine Foundation, its trainers, and affiliates are not liable for health, emotional, or other issues arising from practice. If you need individualized support, consider a private session via our 1:1 support pathway or work with a certified teacher listed in our directory, and continue care with your licensed clinicians.
